Περίληψη της υπόθεσης: Greek authorities arrested and sentenced the applicant, a Syrian national, to ten months’ imprisonment pending expulsion for possession of a false document, false testimony, and unauthorised entry into the country. Despite multiple appeals against his removal order on the basis of his asylum request, claims of unlawful detention and health concerns, the administrative court denied all his objections. The applicant spent fifty-two days detained in the damp and filthy basement of the Zografou Police Station ‘with insufficient light and ventilation…and without access to outdoor exercise.’ Moreover, authorities failed to identify alternative measures beyond detention in light of the applicant’s Syrian nationality and the unlikeliness of deportation. Given the degrading condition of his detention, the authorities’ failure to acknowledge his expulsion as impracticable given his nationality, and lack of judicial remedy to challenge his detention, the Court declared there was a violation of Article 3, Article 5(1) and Article 5(4).
