- The authorities arrested and detained the applicant, an Afghan national, when he was still a minor for unauthorised entry into Greece. Despite his age, authorities placed the applicant in an adult detention facility that suffered from ‘overcrowding, lack of physical activity and healthcare, [and] inadequate food.’ His legal representative requested to transfer him to an appropriate facility for minors, which was subsequently dismissed by the district administrative court given alternative options available to the legal representative to apply for suitable accommodation for the applicant. The underage applicant was only moved to a youth hostel more than a month later by the prosecutor. Given the applicant’s detention for almost two months in an adult facility as an unaccompanied minor and failure by the administrative court to consider the legality of his detention decision, the Court found the applicant’s case in violation of Article 5(1) and Article 5(4). However, the Court rejected the applicant’s Article 3 and Article 9 complaints.
