Περίληψη της υπόθεσης: This case concerns fourteen applicants, including nationals of China, Egypt, Iran, Ivory Coast and Nigeria, who Greek police detained at Fylakio Detention Centre. Applicants entered Greece irregularly between November 2011 and January 2012. All individuals received expulsion orders and remained in detention despite submitting asylum applications soon after arrival into Greece. Authorities cited the lack of travel documents to verify identification as the reason for continued detention. Reports from various organisations such as the Committee for the Prevention of Torture, UNHCR and Greek Council for Refugees highlighted the grossly inadequate conditions at Fylakio Detention Centre. Issues include overcrowding, deteriorating facilities, severely restricted outdoor access, and lack of personal hygiene products and food. In addition, the legality of their detention could not be reviewed in accordance with international human rights standards. The Court determined that there was a violation of Article 3 and Article 5(4), but no violation of Article 5(1)(f).
