- After his temporary residence permit expired, the applicant, a Georgian national, was detained pending deportation three times due to unlawful residence. He remained at Aspropyrgos detention centre for three and a half months in a space with less than three square metres, cockroach infestations, a lack of sanitary products, and restricted access to the toilet, among many other issues. Authorities rejected his asylum claim, but were unable to deport him given his lack of identification documents. While the Court did not agree with the applicant’s Article 5(1) claims, the Court found the applicant’s detention was in violation of Article 3 and Article 5(4) given the conditions of the detention centre and the lack of effective review of his detention and expulsion decision under domestic law.
