Summary of case: The applicant, an Iranian national, was arrested at the Greek border in 2010 and detained until January 2011 at the Feres Border Guard Department. Whilst in detention, the applicant experienced inhumane and unsanitary conditions including ‘overcrowding, deficient hygienic conditions, impossibility to exercise and limited access to medical care.’ Though the applicant filed for asylum while detained, the border police rejected his application. Upon release, the applicant traveled to the United Kingdom and applied for asylum. Basing its decision on the applicant’s account, international reports, and the lack of rebuttal by the Greek government, the court determined that the applicant’s detention was in violation of Article 3.
